Our position
Everything a client shares with Agents In White — architecture, data, commercial terms, roadmaps, internal process, the fact of the engagement itself — is treated as confidential by default, whether or not it is marked. Our work is closed-source and stays that way: we do not publish client systems, we do not reuse client material as a case study without written permission, and we do not name clients unless asked to.
The obligation is mutual. Our own methods, prompts, tooling, and architecture are equally confidential, which is why we execute one instrument covering both directions rather than a one-sided undertaking.
What the agreement covers
- Confidential information in any form, including anything a reasonable professional would understand to be confidential.
- Permitted use limited to evaluating and delivering the engagement, on a need-to-know basis.
- Standard exclusions: already public, independently developed, or lawfully received from a third party.
- Compelled disclosure handled with prior notice where legally permitted.
- Return or deletion of material on request at the end of the discussion.
- Dutch law, with the Rechtbank Den Haag as the agreed forum.
Before you send anything
Do not put confidential material into the private access form. Send a short, non-confidential outline, and we return a signed NDA first. Only after it is executed do we ask for systems, data, or documents.

The template below is the agreement we sign, with AIW's details completed and the counterparty fields left as fill-in lines. Signature blocks are intact — sign electronically or in counterparts.
Confidentiality during a live project is also written into our Engagement Terms, and personal data is covered separately by the Data Processing Agreement.
